Good Franchise Attorney for a Franchisee or Franchisor?

Certainly I have met a few franchise attorneys in my day? Could I recommend one? The better question would I recommend a Good Franchise Attorney? What an oxy-moron. Good Franchise Attorney? Maybe a wealthy franchise attorney, but good; Ha? Whose team are they on; their own team; making a buck. That is what good franchise attorneys do. Make a buck. That is why they are in business as attorneys in the first place. Yet every buck made by a franchise attorney must either come from the franchisor or the franchisee. That is money that a franchisor could use to promote goodwill, brand name recognition, advertising, training, R & D, or acquisitions, which helps franchisees? Or in the case of a franchisee, that money could be used for college tuition, additional units, retirement fund or home renovations. An attorney that cares about the needs of franchisees; very few although I have met a few; lets face it attorneys are the most self-serving creatures on the planet, so we should not kid ourselves. An attorney, which helps franchisors? Yes, if it guarantees them future billable hours. You see the truth of the matter is there is no such thing as a good attorney whether they be in the franchising sector or not. Personally if I were god, Id send them all to hell immediately. Wood Turning - A Sign of Lost Education

By Darrell Feltmate One of the frequent responses to wood turnings which are seen at craft shows or homes is the familiar sentence, “I did that back in high school.” This is usually followed by a musing on how close that was to twenty, thirty or more years ago. Unfortunately this is being lost from the students of today. Many of our schools in Canada and the United States have begun to cut back on what are regarded as extra programs as our baby boomer population ages and the number of students in our school systems dwindles. However, the type of students we receive into the schools has not changed. The diversity of interests held by various young people has remained legion, although we might divide them into some broad categories. Some are academically oriented and are destined for college. It is understood by many educators that these children need the challenge of advanced courses in maths and sciences as well as a solid grounding in the liberal arts. While it might be understood that music would be valuable for them, the same is seldom thought about auto mechanics, home economics or carpentry. Another group seems to be at school to major in sports and feels that the course work is a necessary but not sought after evil. Theirs in the world of movement and athletic endeavor where results are measured in the accomplishment of short term goals, the winning of a game , that lead to greater opportunities, the local or national championships. There is a great question as to whether something like industrial arts would be a reasonable educational avenue or a waste of time, particularly as many of these students are hoping for an athletic scholarship which would entail excellence on the playing field and good marks as well. The third group is seldom considered. These are the people who love to work with their hands. Some are artistic while others are people who appreciate a fine craft. Many of our schools, as has been mentioned, seem to think that these people need no education and leave them to their own resources when it comes to exposure to and education in their chosen interest. However, these are the very people who keep much of our civilization going. They will be the ones who learn to fix the plumbing, check the brakes on the car, cook our meals, wire our homes and so on. Many of this third group will be labeled trouble makers by their schools because their educational needs are largely ignored. With their hand-on style of learning thwarted by the educational system they tend to become bored and bored students are trouble making students. One solution may be the re-introduction of wood turning to the educational curriculum. For a modest investment schools can move in lathes and tools for a class. The academic crowd can experiment with design and artistic development while the athletic group can find challenge and easily viewed short term and long term goals. Those who love to work with their hands are self explanatory. While a wood lathe and a turning course is not a panacea for all our educational ills, it is a good starting point for many of our children. Of course there is the problem of budgets to consider. Wood turners are generally a group of people who love to share what they have learned about the craft. Some wood turning clubs have begun very popular after school programs with volunteers to teach wood turning to interested students. While this is not as ideal as teaching wood turning as part of the curriculum or for that matter as part of a full industrial arts program, it is a possibility for schools on limited budgets to reach the interests of some of their students. It’s Almost Midnight! Do You Know Where Your Profitable Customers Are?

By Jim Deyo Do you have any idea how much your customers are actually worth to you? Do you know which ones you make money on and the financial impact of those that beat you up over price, service levels and “extras?” Or, do you say things like “we don’t have the time to figure that out,” - or, “we are different,” - or, “how would knowing that really help us” - etc, etc? What could be more relevant to any small business than having at least a basic understanding of customer profitability? Usually when a company looks honestly at its customers, the realization jumps off the page that you make a lot of money from some customers, you make less on another group, and you probably lose money on some. When you think in terms of the factors that drive this in your company, you can begin to take steps to make sure you retain the profitable ones and not spend too much of your time on the others. There are several ways to look at customer profitability, but one of the best is to think in terms of the lifetime value of an individual customer. Lifetime customer value (LCV) is the amount of profit that you will realize from an individual customer over the time that that customer does business with you. Focusing on LCV gets you two things. First, it measures the profitability of your customers, not just the revenue, and, because there can be a big difference in margin and costs between customers, the amount of money you make can be very different. Second, LCV focuses on your overall, long-term relationship with customers, not recent transactions, and over time some relationships have the potential to be a lot more valuable than others. The challenge, of course, is that when you start thinking about how to implement this concept, you quickly realize that it can be expensive and time consuming to collect the information you need to really impact your bottom line. But, what if you could get “80%” of the benefit of knowing the LCV of your customers for “20%” of the investment? Wouldn’t you be willing to spend a few hours and maybe do a little tracking and forecasting, if it would make you more profitable? Here are some things you can do. Start by creating a list of characteristics that describe both your ideal customers and your less than ideal customers. The objective is to identify both the quantifiable and the intangible factors that influence the profitability of an individual customer. For example, a long time customer, or a customer that makes multiple purchases, is better than a new one, for the obvious reason that it gives you a bigger revenue stream and the not so obvious reason that it doesn’t cost you as much to market, sell to, and service that customer. A customer that has been in business for awhile, or buys higher margin products, or refers other business to you, or who you can use as a reference is a lot more valuable to you than one who is always pushing you on price, or takes up a lot of your time, or who requires that you stock inventory that you otherwise wouldn’t, or who is just generally difficult to deal with. The more that you can quantify in describing these customers the better; but the intangibles are important, too, because there are hidden costs involved. Then divide customers into 3, or 4 revenue groups. You can refine this later, if you want to, but you need a starting point. One place to begin is some combination of number of purchases, average sale amount, or total sales per customer. Looking at number and dollars of sales splits your customer base either by revenue (dollars), or activity (number). These are two of the important things that drive profitability. Sometimes a better place to start, if you have the information, would be 3, or 4 divisions based on gross profit margin, or some other key profit driver. If you don’t know gross profit margin by customer, you could divide your customer base by number, or dollars of sales, look at the margin for a few representative customers in each group, and make some assumptions about the margin for the entire group. The value of an initial division by gross profit margin is that you have already made a big profitability distinction in grouping your customers. Finally, look at your expenses a little differently and break them into 4 categories. These 4 expense categories are cost of goods sold (the cost of making or buying the product you sell), sales and marketing (the cost to get and keep your customers), fulfillment (the cost to deliver your product to customers), and general and admin (everything else). A few assumptions have to be made here and in some cases you might have to split an expense between more than one of the four categories. But, once you’ve done this, you can look at your expenses in a different way - i.e. how they are affected by individual customer transactions. In restating expenses and matching them to the revenue groups, keep in mind several things that can meaningfully impact the profitability of any customer group and ultimately the total profit of your business. The number of customers in each group is important, because some of your expenses will be related to this. For example, shipping and handling is partly driven by the number of customers that you ship to. The number of new, versus repeat buyers is key, because you really don’t need to spread as much sales and marketing expense to the “old” customers as you are to the “new” ones. There may be costs related to a particular group for sales and marketing, or fulfillment. Fixed, versus variable costs are important, because you benefit from spreading fixed costs over as many customers as possible, while variable costs can rise or fall based on the number of customers that you service. And, finally, don’t neglect to consider time you and you staff have to spend servicing customers. Salary expenses are fixed in total (at least in the short term), but the amount of time that a customer demands can vary greatly and in that sense can be “hidden” costs as you look at the profitability of any customer. If you are so inclined, you can bring these assumptions together in a financial model that lets you forecast LCV with some precision. But, consider what you have learned already by taking these few steps. You’re recognizing in a more focused, analytical way, that not all customers are the same. You see more clearly that the amount of sales to a customer is not all that matters. The margin is a lot higher for some customers that for others. Your company’s expenses take on a different meaning, because they now generally reflect what it costs you to get, keep, and service your customers. You’re thinking in terms of some of the key factors that impact the profitability of any of your customers. If you stop here, you have spent a few hours of your time, but you still have benefited from understanding more about how much you might make, or lose, from different groups of customers. How to Perform the Make One - Yarn Over and Bar Increases in Knitting

By Megan Kutchman There are five common ways to perform the “make one” increasing technique you’ll see in some knitting patterns. To make one is to increase your knitting by one stitch. Depending on the pattern, you may be instructed to make one several times in a row. Here are the five ways to increase in knitting: Knitting into the front and back of one stitch This will make an increase almost invisible. To do this, begin knitting a stitch like normal, but don’t pull the stitch off the left needle. Instead, point your right needle down and toward the back side of the left needle. Insert your right needle (while it’s pointing down) into the stitch on the left needle and knit as normal. Knitting into the stitch below This is another nearly invisible increase. Knit the stitch below the top stitch on your left needle. This is a more awkward method of increasing and tends to make the stitches tighter if you’re not careful while you knit the increase. Yarn Over This is the more widely known method of increasing. A yarn over increase will result in a gap in the knitting that looks like a hole. This is useful for making designs in a pattern and is often use in conjunction with a knit two together decrease to make an eyelet pattern. To perform the yarn over increase, wrap the yarn around the needle as you would when knitting a stitch. For example, you can knit a stitch, yarn over, then knit another stitch. The yarn over has to be done between stitches. Bar Increase This increase results in either a hole or a right-slanted stitch, depending on how it’s done. Hold your knitting project like normal, with a needle in each hand, and you should notice what’s called a “bar” between the needles. It’s the top strand on the stitch between the needles. To do a bar increase, insert your right needle through the front of this bar and lift it up onto your left needle. Now you can either: -knit into the back of this stitch which will result in a small hole -or knit into the front of the stitch for a right-slanted stitch Knitted On Cast On Increase If you’re familiar with the knitted on cast on technique, you can increase this way as well. To increase this way, begin as if to knit a stitch but instead of taking the stitch off the left needle, move the newly knitted stitch from your right to your left needle. How to Make Your Apartment Safe

By Kyle Haley There are special dangers involved with apartment living. This is because you live so close to many other people. Their actions can jeopardize your safety and so its very important for you to be aware of what you must do to safeguard yourself, your family and your possessions. Fire Safety . . . Fire is perhaps the greatest danger in apartment buildings. With so many units joined together, it doesnt take long for fire to spread from one to another. The following guidelines are critical to your safety: Install smoke detectors in the kitchen, all bedrooms, the laundry area and hallways. You must test them every month and replace the batteries every 6 months. They wont do you any good if they arent in working order. Keep fire extinguishers handy in the kitchen, laundry area and near your outside grill. Develop an escape plan. This plan should include two ways of exiting in most cases, this will probably include the main door and either a window or door wall. If you live on a higher floor and dont have access to a fire escape, purchase a rope ladder to use for exiting from windows or a balcony. Practice your escape plan regularly so each member of your family knows exactly what to do in case of fire. Never use an elevator during a fire. Never park in front of fire hydrants or in fire lanes and make sure your guests dont either. General Safety . . . Fire isnt the only danger in an apartment building. You must also be aware of hazards that can exist no matter where you live and take precautions to prevent them. Install a carbon monoxide detector. Install screen guards or window stops and doorstops on your patio door to protect your children from falling. Keep your apartment and building number near the telephone so your family or babysitter can access it in case of an emergency. Remember that memories can fail during emergencies. Make certain your apartment number is clearly marked on your door. Be sure that each person in your family knows how to dial 911. Protecting from Intruders . . . There are many people coming and going in an apartment complex. Criminals count on this anonymity. That makes it very important to get to know the other tenants.
